Case of attack on Nalchik will be further proceeded by professional judges

In session of the trial on the case of attack on Nalchik, the court dismissed the petition of the majority of defendants and their advocates on passing the case to the Supreme Court for the jury trial. The Court finds that the failure to form an objective and impartial panel of judges does not give the court grounds for granting this petition.

In justifying their refusal, the court cited a fact that the ruling made by Judge Mohamed Tashuev in February 20, 2009 on referral of the case to the Supreme Court for the trial of the three professional jurors was appealed by the defendant and his defense in cassation proceedings, and it was dismissed by the decision of the Supreme Court of the Russian Federation.

According to the court, contrary to the defense, the situation is not inconsistent with the Constitution, because in line with the Constitutional Court decision of 19.04.2010, "had the formation of objective and impartial jury failed, one should not restrict the citizens' right of legal and fair trial, which the trial of the three professional jurors is indeed declared by the CPC."
