The sentence of a Karachay-Cherkessia resident following a traffic accident involving tourists was upheld.

The Supreme Court of Karachay-Cherkessia upheld the sentence of a local resident whose faulty vehicle injured several tourists.

As reported by Caucasian Knot, tourists from the Rostov Region who were injured in a bus crash in Karachay-Cherkessia were unable to obtain compensation from the travel agency. The head of the Investigative Committee demanded that a criminal case be opened.

The court made editorial changes to the verdict, but the rest of it was left unchanged – a nine-month restriction of liberty without deprivation of the right to engage in activities related to driving, according to the joint press service of the courts of Karachay-Cherkessia.

The case was classified under Part 2 of Article 238 of the Russian Criminal Code (provision of services that do not meet consumer safety requirements, resulting in the infliction of serious bodily harm through negligence). 1 .

In August 2024, the Karachayevsky District Court found the defendant guilty and sentenced him to a suspended two-year prison sentence with a three-year probationary period. The court also upheld the victims' claims for compensation for damages totaling over 800,000 rubles, but the Karachay-Cherkessia resident disagreed with the decision and appealed it. As a result, the trial court's decision was overturned, and the case was sent for a new trial, the press service reported.

However, the court had already qualified the defendant's actions under another article - Part 1 of Article 264 of the Russian Criminal Code (violation of traffic rules by a person driving a vehicle, resulting through negligence inflicting grievous bodily harm to a person) 2 .

"The appellate court, having reviewed the criminal case and verified the arguments of the appeal, made editorial changes to the verdict. The rest of the verdict was left unchanged," the report said.

Earlier, "Caucasian Knot" reported that the court sentenced to three A Sarov resident who organized a rafting trip down the Bolshoy Zelenchuk River in May 2021, which ended in the death of a tourist, received a suspended sentence of years.
