Sochi residents Baranetskaya and Yatsko claim the court is biased

The mothers of the pupils of the Sochi kindergarten, Elena Baranetskaya and Irina Yatsko, who were fined for insulting the daughter of the headmistress, filed cassation appeals against the court's decisions, which found the fines to be lawful.

As "Kavkazsky Uzel" wrote, after the incident in the Sochi kindergarten, the parents of the pupils accused the institution's management of concealing the facts of cruel treatment of children and inaction. At the same time, the prosecutor's office drew up administrative protocols against the parents themselves, accusing Irina Yatsko and Elena Baranetskaya of insulting the headmistress and her daughter. On May 29, the court fined Yatsko five thousand rubles, and on June 3, Elena Baranetskaya was fined the same amount . According to Baranetskaya, the court refused to include evidence in the case, including correspondence confirming provocations by opponents, and later the woman discovered that a number of documents were missing from the case materials .

On July 30, Elena Baranetskaya and Irina Yatsko filed preliminary cassation appeals against the appellate decisions of the Adler District Court, which on July 28 upheld the fines imposed by the magistrate's court.

“During the appeal, the judge listened to my complaint for only 15 minutes. Although “listened” is the wrong word, he did not listen to anything at all, and he had prepared the rejection of my appeal in advance. He allocated 15 minutes only for the formal procedure. In both cases, these were not trials, but simply persecution for expressing an opinion that it is wrong to treat children cruelly,” Irina Yatsko told a “Caucasian Knot” correspondent.

She specified that she filed a preliminary complaint in order not to miss the deadline, since she, like Elena Baranetskaya, has not yet been given a decision on the appeal, having been told to “wait five days.”

Elena Baranetskaya also filed a preliminary cassation. "We pointed out all the violations - holding sessions in offices, the court's refusal to listen to our arguments. The judge ignored the audio recording, in which the headmistress's daughter and the headmistress herself called us "inadequate", "abnormal", "crazy" in the courthouse. I asked to stop these insults, which continued in the judge's office, during the trial, and to include them in the protocol, but the judge pretended not to hear anything," said Elena Baranetskaya, a mother of many children.

Baranetskaya emphasized that her complaints are related not only to the trial, but also to the conditions in the kindergarten. “It’s terribly hot in Sochi. Children are suffering at 30-40 degrees in a room without air conditioning, although the kindergarten has rooms with air conditioning. I asked to transfer my child, but the director replied: “Buy an air conditioner yourself if your child is hot.” Meanwhile, SanPiN requires creating normal conditions for children. The director also refuses to install video cameras so that parents can be sure that their children are not beaten or insulted in this kindergarten,” she emphasized, recalling that the investigation after the publication of the video recording did not lead to punishment of the kindergarten employees.

Lawyer Vyacheslav Denisov, who advises both women, recommended conducting an independent linguistic examination. "We need to check the statements of Baranetskaya and Yatsko in the chat for insults and conduct an examination of the statements of the director and her daughter. If the experts establish the facts of insults on the part of the kindergarten staff, we will file a complaint with the prosecutor to initiate an administrative case against them. We also need to continue to seek to hold the teacher who treated the children rudely accountable and to seek the installation of video cameras. Parents' concerns about their children are justified given such an attitude towards their parents," Denisov noted.

Elena Baranetskaya emphasized that she will not leave the case unattended. "I am acting in the interests of the children of kindergarten No. 121, where many parents are afraid to tell the truth, fearing for their little ones. But I can’t keep quiet,” she concluded.
