ECtHR awards compensations to two residents of Southern Russia for non-providing medical care in colony

The European Court of Human Rights (ECtHR) has awarded 15,000 euros in compensation for the suffered material damage and moral harm, as well as for legal expenses, to Alim Khokonov from Kabardino-Balkaria and Khristofor Golovatov from Rostov-on-Don. They were diagnosed with oncological diseases, but they were not provided with medical care in colony, says the ECtHR's decision, posted on its website on July 7.

The case was initiated on several complaints against Russia, filed with the ECtHR in accordance with Article 34 of the European Convention of Human Rights (ECHR), which were combined into one case. The applicants complained mainly that they had not been provided with adequate medical care in custody. They referred to Article 3 of the ECHR, which reads that "No one shall be subjected to torture or to inhuman or degrading treatment or punishment".

The ECtHR has revealed shortcomings in the applicants' medical treatment and indicated that they failed to receive the due comprehensive and adequate medical care while in custody.

It should be noted that Alim Khokonov and Khristofor Golovatov will not be able to receive the awarded compensations, since on June 11, 2022, Russian President Vladimir Putin signed the bill earlier adopted by the State Duma on non-execution of ECtHR's decisions issued after March 15, 2022.
