Azerbaijani oppositionist considers unfair ECtHR’s decision on complaint against his arrest

The European Court of Human Rights (ECtHR) excluded from the list of the cases under consideration a complaint about the pre-trial arrest of Azerbaijani oppositionist Alikram Khurshudov after the government promised to pay compensation to him. The oppositionist himself said that he refused a settlement agreement with the authorities and was dissatisfied with the amount of compensation.

The “Caucasian Knot” has reported that Alikram Khurshudov was detained on November 22, 2017 and arrested on suspicion of disorderly conduct with the use of weapons and resistance to a police officer. On May 4, 2018, a court sentenced Alikram Khurshudov to five years of imprisonment.

Today, the European Court of Human Rights has announced that the Alikram Khurshudov’s complaint about his pre-trial arrest in Azerbaijan was excluded from the cases under consideration.

“Following unsuccessful negotiations on a settlement agreement, the [Azerbaijani] government informed the court that it had proposed a unilateral declaration in order to resolve the issues raised in the complaint. They also asked the court to exclude the complaint in accordance with Article 37 of the Convention," the report says.

Meanwhile, the Azerbaijani government recognized the violation of the complainant’s rights guaranteed by Paragraph 3 of Article 5 of the Convention and expressed its readiness to pay compensation to Alikram Khurshudov in the total amount of 3500 euros.

Alikram Khurshudov himself declared his disagreement with the decision of the ECtHR. “My case was of a political nature, I was groundlessly and unlawfully taken into custody. The decision of the ECtHR is inadequate in relation to the injustice that I faced when I was subjected to unjustified imprisonment, moral and material deprivation,” Alikram Khurshudov told the “Caucasian Knot” correspondent.
