ECtHR agrees with Azerbaijani authorities' proposal in Gyulyalyev's case

At the request of the Azerbaijani government, the European Court of Human Rights (ECtHR) has excluded from the list of considered complaints the application of Ogtai Gyulyalyev, the coordinator of the public alliance "Azerbaijan without Political Prisoners". The country's authorities have undertaken to pay compensation for his arrest.

The "Caucasian Knot" has reported that a criminal case against Ogtai Gyulyalyev was instituted in 2012. According to his story, no investigation was conducted under his case; and he received no answers to his demands to provide him with any information on the investigation outcomes. He saw political motives in his criminal prosecution.

Ogtai's advocates sent a complaint to the ECtHR about his criminal case and his arrest, the "Turan" News Agency reported on March 5.

In the course of the proceedings, the Azerbaijani government offered amicable reconciliation to Gyulyalyev, agreed to admit a violation of his rights and pay him compensation of 3500 euros. However, Gyulyalyev rejected this offer; and then the government submitted a unilateral statement to the ECtHR and asked to exclude the case from consideration, the "Turan" has informed.

On March 5, the ECtHR decided to exclude the complaint from the cases under consideration, taking into account the government's obligation to pay compensation to the applicant of 3500 euros, of which 3000 is compensation of moral harm, and 500 euros – for compensation of legal expenses, says the ECtHR's decision posted on its website. It is also stated that should the government fails with its promise stated in its unilateral statement, the complaint can be restored in the list of pending cases.
