Defenders of Kurman-Ali Baichorov file cassation against Court's decision to recognize investigators' actions as legitimate
Defenders of Kislovodsk Imam Kurman-Ali Baichorov have filed a cassation to the Presidium of the Stavropol Regional Court against the decision of the Board of Appeals and the resolution of the Predgorny District Court concerning the complaint to recognize unlawful the actions of the deputy head of the Investigating Division of the Investigating Department for the Predgorny District of the Investigating Committee of the Russian Federation (ICRF).
The "Caucasian Knot" has reported that in October 2013, Kurman-Ali Baichorov was detained on suspicion of illegal possession of drugs and arrested by the court's decision. Imam has claimed that he fell victim to falsification. On October 22, 2014, he sent a complaint from the IVS (temporary detention facility) to Alexander Bastrykin, the Chairman of the ICRF.
However, the IVS sent the Imam's complaint to the police department for the Predgorny District, and its Chief Sergey Pominov sent the complaint further to Sergey Belevtsev, the head of the Investigating Division of the Investigating Department for the Predgorny District of the Stavropol Territory of the ICRF, who, according to Kurman-Ali Baichorov, was not entitled to make a decision on the complaint filed by the Imam. Meanwhile, Sergey Belevtsev instructed his deputy Tkachenko to consider the Imam's complaint; however, he failed to consider the complaint.
The Sergey Pominov's actions were challenged in two court instances and found unlawful; however, the Tkachenko's actions were recognized by the court as legitimate.
Advocate Taulan Ebzeev has explained that to challenge the actions of Pominov and Tkachenko, the complainant was to file two separate complaints, since they "were two different officials."
