Member of polling site commission in Sochi Vitaly Nebieridze fined to 500 rubles for insubordination to the police

Today member of polling site commission No 45-09 in Sochi Vitaly Nebieridze charged with insubordination to the police personnel who were called by Chairperson of the polling site Ludmila Afanasieva during vote-counting procedure was fined to 500 rubles by the Magistrate of Magistracy No 97. The observer himself considers the judgment unlawful and declared that he was going to appeal against it.

We will remind that on October, 14, Vitaly Nebieridze was present as an observer in the polling site of "Sochi" Central military camping where voting at the election of Legislative Assembly of Krasnodar region was held. After the polling site was closed Nebieridze was delivered to Khosta district Department of Interior Affairs for insubordination to the police. The observer could not participate in vote-counting procedure and spent twelve hours in Khosta district Department of Interior Affairs.

Magistrate Larisa Mamisheva acknowledged Vitaly Nebieridze guilty according to clause 19.3 of Code of administrative violations (insubordination to a legal demand of a policeman).

According to Vitaly Nebieridze, the trial lasted a little longer than 5 minutes, without an attorney, witnesses or claimants.

"The Magistrate acknowledged my guilt proved in full. She was guided by a protocol drawn up by policeman Kiriyan and statements of members of the commission looking like written under carbon paper", Vitaly Nebieridze said to the "Caucasian Knot" correspondent.

He thinks that the documents considered by the Magistrate contain false denunciation and slander.

"I was accused of allegedly hindering the committee from work, being rude, using obscene words, pushing a police officer and running away putting up a resistance. But there was nothing of the kind. I just demanded to carry out procedures stipulated by the law for an observer, member of polling site commission and a trustee, i.e. to show me the documents counting of which seemed to me doubtful. I consider that they deliberately put obstacles in my work in the polling site commission which influenced legal results of the election in this polling site", Vitaly Nebieridze says.

He is going to appeal against the judgment considering it unlawful and groundless.

Valery Suchkov, member of civil movement "For fair election", also doubts about lawfulness of the verdict brought by the Magistrate. He considers that to establish the truth the Magistrate should have summoned all the parties of the conflict to court and given Vitaly Nebieridze's attorney who submitted the respective written motion yet in the police department an opportunity to participate in the trial.

According to lawyer Alexander Popkov, at night he came to the police of Matsesta after receiving the news of Vitaly Nebieridze's kidnapping. But the lawyer states that the police not only disallowed him to enter the building but even concealed the fact that Vitaly Nebieridze was there.

Magistrate Larisa Mamisheva and Chief of Khosta district Department of Interior Affairs Alexander Bondarev told the "Caucasian Knot" correspondent that if Vitaly Nebieridze acknowledged guilty considered the actions of the magistrate's court and the police unlawful he could appeal to a higher instance juridical against the verdict and to Public prosecutor's office against the action of the police.

Earlier, the "Caucasian Knot" reported that 17 parties took part in the election of the Legislative Assembly. As of 8:00, September, 15, "United Russia" polled 69% votes, KPRF 8%, LDPR and "Fair Russia" 4% each. So, only "United Russia" and KPRF will become members of regional Parliament. Representatives of the opposition reported a great many violations in the polling sites of Krasnodar region on the voting day. Today representatives of "Fair Russia" declared illegitimacy of the election in the region and informed that materials on violations were sent to Moscow. Meanwhile, a representative of regional Election Committee stated that on the whole the election day passed in a clam atmosphere and many complaints and appeals on the order of voting were not confirmed during inspection.
