Rasul Kudaev's complaint on tortures returned to prosecutor's office of Kabardino-Balkaria capital

The Nalchik City Court has considered a complaint lodges by Rasul Kudaev on the ruling of the Nalchik prosecutor's office to abandon opening a criminal case on application of physical force to him by the members of law enforcement bodies and retuned it back to the Nalchik prosecutor's office for additional investigation.

Kudaev's complaint runs that on October 28, 2005, we was taken out of the pre-trial custody ("SIZO") to an unknown law enforcement institution, where he was physically violated with the aim to kick out of him a confession of his attack on Nalchik. After his refusal to evidence, he was beaten and tortured.

The complaint was accompanied by two forensic medical examination certificates to confirm the facts of Kudaev's beating.

The ruling on abandoning to initiate a criminal case made by the Nalchik prosecutor's office states that Kudaev's bodily injuries "could have been inflicted during his detainment."

We remind you that Rasul Kudaev, a citizen of Hasanya settlement, was detained on October 18, 2005, as a suspect on taking part in an attack on Nalchik. Earlier, in 2002-2004, Rasul Kudaev was imprisoned at the Guantanamo American base, where he was taken from Afghanistan. In Afghanistan, Rasul Kudaev found himself, according to his relatives, on his way to Pakistan to obtain education.

Currently, Rasul Kudaev's complaint is at the European Court for Human Rights.
