ECtHR starts communicating on Elshad Babaev's death in Azerbaijani colony
The European Court of Human Rights (ECtHR) has requested the Azerbaijani authorities to provide information about the death of prisoner Elshad Babaev, who, according to a sister of the deceased man, died as a result of torture.
The "Caucasian Knot" has reported that on December 22, 2014, Elshad Babaev, accused of using drugs, died in the penal colony No. 14 not far from Baku. According to medical expertise, his death was caused by heart attack. The case of his death was investigated under the article on abuse of office, but Elshad Babaev's relatives insisted on an investigation into a case of murder.
The ECtHR has sent questions to the Baku authorities in connection with the complainant's request to recognize violations of rights under Article 2 (right to life), Article 3 (prohibition of torture) and Article 13 (rights to effective remedies) of the European Convention on Human Rights, reported advocate Samed Ragimli.
According to advocate Khalid Bagirov, the complainant believes that her brother died after he had been beaten in the penal colony and got no medical help.
The advocate has clarified that the complaints against the decision pronounced by the Prosecutor's Office were dismissed by Azerbaijani courts, and therefore the complainant filed an appeal to the ECtHR.
