Azerbaijani SC upholds refusal to re-investigate Giyas Ibragimov's case

The Supreme Court (SC) of Azerbaijan has dismissed a cassation appeal filed against the refusal of the court of appeal to carry out the re-investigation into the activist Giyas Ibragimov's case.

The "Caucasian Knot" has reported that at the preliminary court hearing in the Giyas Ibragimov's case held on December 13, 2016, the Baku Court of Appeal (BCA) dismissed the defence's request to carry out a partial re-investigation into his case and scheduled the consideration of the appeal on the merits for December 26, 2016. However, the defence has voiced the dissatisfaction with such a Court's decision.

"We drew the attention of the judges of the Supreme Court to the fact that at the court hearing, the BCA dismissed all 20 motions of the defence that were important for restoring justice with respect to Giyas Ibragimov," reported advocate Elchin Sadygov.

According to the advocate, the first instance court committed "a lot of violations" that allow "claiming confidently that no objective judicial investigation took place."

The advocate has also added that the Supreme Court of Azerbaijan "deprived Giyas Ibragimov of his right to a fair trial." Elchin Sadygov has also announced his plans to file a complaint to the Strasbourg Court about violation of the activist's rights by the Supreme Court of Azerbaijan.

Let us remind you that Giyas Ibragimov was included in the list of political prisoners released by Azerbaijani human rights defenders on October 17, 2016.
