POC claims violation of rights of blind man accused of double murder in Sochi

The Krasnodar Regional Court of Appeal has refused in appeal consideration of the complaint filed by Sochi resident Mark Yavorsky, Category I visually impaired person, who was accused of killing two men. The defendant, his defence, and parents claim false conclusions of the investigation, and members of the Public Oversight Commission (POC) reports on violation of the defendant's rights to qualified medical care.

The young man is visually impaired with a diagnosis of "optic atrophy in both eyes." The defence insists that the defendant was not physically able to kill three adult men. Besides, he has got an alibi proving that he was not at the crime scene. That is confirmed by records from a video surveillance camera.

"However, the investigators and the first instance court categorically refused to accept proof of innocence of Mark Yavorsky," claimed the advocate.

Marina Romanova, a member of the POC for the Krasnodar Territory, has noted she believes that the young visually impaired man, who yet in school was characterized in a positive way, was "physically unable to commit the double murder with cruelty described in the verdict of the court."

Mark Yavorsky, who is being kept in custody since January 20, 2015, complained about torture.

Oksana Yavorskaya believes that her son is not involved in the crime. According to the woman, "on the contrary, he tried to help homeless people and tried to separate them during a fight."
