In Sochi, farmers refuse to hand over to "Rossiya" a land plot with fruitful garden

Top managers of the agricultural enterprise "Rossiya" (Russia) went to court to demand from farmers to vacate a land plot with a feijoa garden. The farmers claim an attempt to illegally take away their source of income.

Seven persons are listed in the lawsuit. The contract was drawn up for 25 years. Its term has expired; however, the farmers believe that after the expiration they still lawfully used the leased land plot, since at the end of the term of the contract they did not receive from landlords no objections, and therefore the contract should be considered as prolonged automatically, in accordance with Article 621 of the Civil Code of Russia. Moreover, the farmers refer to the fact that the trees grown on the land plot are their property and they have no place to move them.

The farmers are also worried that Viktor Markov, the new director of the State Unitary Agricultural Enterprise (SUAE) "Rossiya", does not plan to use the disputed land plot for agricultural purposes at all.

Alexander Boichenko, the chair of the Sochi branch of the Capital Bar Association of Moscow told the "Caucasian Knot" correspondent that in that situation, "the tenants are right, since they act in accordance with the purpose of the land plot where their property is located, to which they have every right."

According to the advocate, the tenants may file a counter-claim for recognition the property right to the garden in order to prove that it was planted and raised by them.
