Territorial Court quashed decision of Sochi Court to grant flat to fire victims by Mayoralty

The Krasnodar Territorial Court chaired by Judge Irina Kombarova has reversed the ruling of the lower instance, which had ordered the Sochi Mayoralty to provide comfortable housing to a family of fire victims with minor children. The case was considered by the Territorial Court on May 13, said the press service of the Court.

The "Caucasian Knot" has reported that since 2006 Desdemona Djamburiya, a resident of Sochi, has been trying to get an apartment from the Mayoralty instead of her burnt-down house. In the place where her house was, now high-rise apartments have been erected, but there is no flat for the fire victims there.

The Mayoralty believes that the Territorial Court made a fair decision, since Desdemona Djamburiya's burnt-down house had not been recognized as an emergency building; therefore, the Mayoralty is not obliged to provide anything to this family.

"Let the landowner provide a flat to the Djamburiya family," the Sochi Mayor Anatoly Pakhomov told the "Caucasian Knot" correspondent.

Desdemona Djamburiya herself and her family members are dissatisfied with the decision of the Territorial Court.

"We can say that since 2006 we in fact live in the courts," Desdemona Djamburiya told the "Caucasian Knot" correspondent, explaining that she had already lodged a lawsuit against the developer, but the head of the building company had transferred all his assets to some third parties.

The woman believes that her house was set on fire deliberately, and emphasizes that it was right after the fire that luxury housing was built on the land plot. "We don't want anyone profiting from our misfortune," Desdemona Djamburiya has concluded.
