Moscow City Court has not answered claims of relatives of people perished during act of terrorism in Dubrovka

The Moscow City Court did not answer on Monday the first three of 24 claims to the Moscow City Government for moral and material damage compensation to the sum of 4 million dollars. As it was reported at the court secretariat, the Moscow City Court kept valid the decision of the Tverskoy Court of Moscow of January 23, 2003. The Tverskoy Court did not answer the claims of the Khramtsovs and Karpovs, as well as Muscovite Zoya Chernetsova on the basis of the federal legislation ?containing no direct evidences of a necessity of compensation payments to the victims by the subjects of the Russian Federation?. The decision of the Moscow City Court was motivated by the fact that the Civil Remedial Code of the RF ?does not provide for an appeal of the decisions of the court of first instance in the court of second instance?.

We remind that three weeks ago the Moscow City Administration and the Moscow Finance Department refused to enter into an agreement of lawsuit with the relatives of the victims. The advocate of the victims Igor Trunov declared yesterday he intended to lodge an appeal to the Presidium of the Moscow City Court, and also, if necessary, to send an address to the Supreme Court of Russia and the European Court of Human Rights.
